Data protection

Quirurgil S.A.S. processes personal data in the course of its business as a medical device distributor. This policy explains what information we collect, what we use it for, how long we keep it and how you can exercise your rights. It is adopted under Colombian Law 1581 of 2012, Decree 1074 of 2015 and the other Colombian data protection rules.

Who is responsible for your data

Quirurgil's administrative area is in charge of handling enquiries and complaints relating to personal data.

What data we collect and what for

Quirurgil processes personal data in accordance with the principles and rules set out in Colombian Law 1581 of 2012 and other applicable regulations. Data may be provided directly by the data subjects or lawfully received from third parties, within commercial, contractual, employment or legal relationships.

When you contact us

If you write to us by email or WhatsApp, or call us, we process your name, your contact details, the institution you work for and the content of your request. The purpose is to answer your enquiry, prepare a quotation, arrange a demonstration or provide technical support on a device.

When you apply for a vacancy

If you send us your CV, we process the information you include in it: identification and contact details, education, work experience and references. The purpose is to assess your profile against the vacancy, carry out the selection process and contact you. If the process does not go ahead, the CV may be kept for the period communicated to the data subject and, where applicable, with their authorisation, to be considered in future selection processes.

When you use the website

The site search and the Gilbert assistant run inside your browser and do not store what you type on a Quirurgil server. The site uses no advertising cookies and no third-party tracking cookies.

When you are a customer or supplier

We process the contact details of staff at customer institutions, represented manufacturers and suppliers, in order to perform the contract, invoice, provide technical service, handle warranties, carry out after-sales follow-up and meet the legal, accounting and tax obligations that apply to us.

Sensitive data and children's data

Quirurgil does not request sensitive data in order to handle a commercial enquiry. A patient's health data is the responsibility of the institution treating them, not of Quirurgil: our devices are supplied to institutions and health professionals, not to patients.

If a selection process requires any sensitive data, you will be told that you are not obliged to provide it and your express authorisation will be requested. The site is not aimed at minors and we do not intentionally collect their data.

Your rights

As the owner of your personal data you may, at any time:

• Know, update and correct your personal data
• Request proof of the authorisation you gave, except where the law does not require it
• Be informed about the use we have made of your data
• File complaints with the Superintendency of Industry and Commerce
• Withdraw your authorisation or request deletion of your data, where no legal or contractual duty requires us to keep it
• Access your personal data free of charge

How to exercise your rights

Write to us at info@quirurgil.com stating your name, a contact detail and your specific request. If you are asking for correction or deletion, tell us which data it concerns and why, so that we can handle it properly.

• Enquiries are answered within a maximum of ten working days. If that is not possible, you will be told the reason and the date of the answer, which will not exceed five further working days
• Complaints are handled within a maximum of fifteen working days. If that is not possible, you will be told the reason and the date of the answer, which will not exceed eight further working days
• While a complaint is being processed, the data is flagged as “claim in process”

How long we keep your data

We keep personal data for as long as is necessary to fulfil the purposes for which it was collected and, afterwards, for the periods set by the applicable legal provisions or for as long as legal or contractual liabilities may arise. Once those periods have elapsed, the data will be deleted, anonymised or, where applicable, subject to the retention measures required by law.

Who we share your data with

We may pass your data to the manufacturers we represent when it is necessary to process a warranty, a spare part or technical support; to the suppliers who provide us with technology, accounting or logistics services, who act as processors and may only use the data to provide us with that service; and to the authorities that request it in the exercise of their duties.

Some of those manufacturers are outside Colombia. Where there is an international transfer, it will be made with the safeguards required by Colombian law.

Information security

We apply reasonable technical and administrative measures to protect data against loss, unauthorised access, misuse or alteration. Access is limited to the staff who need it to do their job.

Term and changes

This policy applies from the date it is published and remains in force for as long as Quirurgil processes personal data. Any substantial change will be published on this same page. We suggest you review it from time to time.
